Moot Court Society

The Moot Court Society (MCS) is a dedicated cell towards providing a platform to students to inculcate and enhance advocacy and dispute resolution skills. The Society functions as a mentor to students from Day 1 of the college. It organizes training programs and workshops by experts regularly to hone students’ negotiation, mediation, research, drafting and argumentative skills at the nascent stages of college. It also conducts internal competitions to inculcate a general culture of mooting in the college. Members of the society are selected through open moot competitions witnessing the participation of 300+ students judged by renowned practicing advocates. The society also facilitates the internal selection procedure to choose teams to represent the college in external competitions organized both nationally and internationally. The society also organizes one of the most prestigious criminal law moots in the world, the K.K. Luthra Memorial Moot Court Competition.

A newly renovated and specially crafted room to fit the needs of a modern law college has been designed for the Moot Court Society of Campus Law Centre – the Moot Court Hall. As a curricular activity which is indispensable in the life of a law student and which helps them sharpen their advocacy skills, a hall fully focused on Moot Court Competitions and events will give a much-needed boost and encouragement to the sharply growing mooting culture in CLC. The Hall will felicitate in smoothly organizing moot court competitions at CLC.

The family of Moot Court Society, Campus Law Centre had the privilege of having esteemed guests to inaugurate the hall which happens to be an added amenity in college. The program began with the inauguration of the room by Hon’ble Mr. Justice Ajay Kumar Tripathi, Judicial Member, Lokpal & Former Chief Justice, Chhattisgarh High Court, Mr. Amarjit Singh Chandhiok, Senior Advocate, Supreme Court of India, Former Additional Solicitor General of India and Mr. Jagdev, Member, Bar Council of Delhi, Former Member, Bar Council of India. This was followed by the felicitation of the esteemed guests for the event. The welcome address was delivered by Prof. (Dr.) Usha Tandon, Professor-in-Charge, Campus Law Centre. It was followed by the inaugural address by Hon’ble Mr. Justice Ajay Kumar Tripathi. Mr. Tripathi welcomed the initiative of the establishment of the Moot Court Hall for promoting the mooting culture at Campus Law Centre. Subsequently, the Presidential Address was delivered by Mr. Amarjit Singh Chandhiok. The Guest of Honor for the event, Mr. Jagdev also appreciated the initiative of establishing the Moot Court Hall. The event concluded with Vote of Thanks given by Ms. Apanjot Kaur, Teacher Member, Moot Court Society, Campus Law Centre.

The event was a success and the organizing team of the Moot Court Society was praised for pulling off the event at a short notice. This new Hall is an addition to the heritage of Campus Law Centre and will witness some great arguments and striking interpretations of the law in its interiors which over time will add to the legacy of the glorious history of the college. It will surely enable students of Campus Law Centre to excel in moot court competitions across the globe to upkeep the reputation of Campus Law Centre. The Moot Court Society is one of the most prestigious and active societies in college will make full use of such an infrastructure provided to them.

The XVIII K.K. Luthra Memorial Moot Court, 2022 was organised by Campus Law Centre, Faculty of Law, University of Delhi from 7th to 13th March, 2022. This year’s edition of the competition had to be organised after a postponement, owing to the surge of the Omicron variant of COVID-19 in January 2022. Despite the challenges of conducting the moot virtually, Campus Law Centre successfully managed to host 66 teams from a variety of law institutions of repute, including several NLUs and Faculties of Law from across the globe. The competition also witnessed participation from 11 international teams from esteemed universities such as University of Oxford, Islamic University of Sultan Sharif Ali, Brunei, University of Lusaka, Zambia, Faculty of Law National University Singapore amongst multiple other institutions from Zimbabwe, Bangladesh, Nepal and Pakistan etc.

Since 2005, the competition has been organised in the memory of Late Shri K.K. Luthra, Senior Advocate, a leading criminal lawyer whose legal career spanned from 1949 till his demise in 1997. The competition takes his mantle forward in the field of criminal law as being the exclusive criminal law moot court held at an international level in India. This year’s moot problem focused on an appeal revolving around issues, inter alia, murder, the ‘last seen’ theory and circumstantial evidence. The competition commenced with a welcome address by Shri Sidharth Luthra, Senior Advocate, and was followed by the Draw of Lots and the exchange of memorials for the preliminary rounds. The Preliminary Rounds were spread across the span of two days, i.e., 08.03.2022 and 09.03.2022 with over 30 teams competing against each other each day in order to qualify for Octa-Finals. Each team got to argue both for the Appellant and the Respondent side in the Preliminary Round.

The rounds were conducted online on Zoom platform, and the same were judged by eminent lawyers who left no stone unturned in analysing the preparations and the legal acumen of the participants. The Top 16 teams then competed for the Octa-Finals that were conducted on 11.03.2022. Thereafter, the Top 8 teams qualified for the Quarter-Finals. At the end of the Quarter-Finals, the Top 4 teams walked into the Semi-Finals. The Quarter-Finals and the Semi-Finals were conducted on 12.03.2022. The Semi-Finals were judged by renowned and eminent Senior Advocates of the Hon’ble Supreme Court of India.

Participating teams from Symbiosis Law School, Pune and Faculty of Law, Jamia Millia Islamia qualified for the Finals. The Final Round was conducted on 13.03.2022, and witnessed participation by both the finalists in full spirit and zeal. The round was adjudicated by a 3 judge bench comprising of Hon’ble Justices of the Delhi High Court. The team from Symbiosis Law School, Pune comprising Vibhor Chandra, Sonal Jain, Anoushka Das were adjudged the Winners of the competition, while the team from Faculty of Law, Jamia Millia Islamia comprising Sehar Rauf, Janvhi Rastogi and Tanya Jaiswal were adjudged the Runners-Up. The Best Speaker of the competition was awarded to Siddharth Srikanth representing School of Law, Christ Deemed to be University, Bengaluru. The award for the Second-Best Speaker was awarded to Pandit Aradhana Swanand also from School of Law, Christ Deemed to be University, Bengaluru. The Best Memorial was awarded to Jindal Global Law School, O.P. Jindal Global University, Sonipat, Haryana. The Second Best Memorial was awarded to Maharashtra National Law University, Aurangabad. The valedictory ceremony was held in the presence of esteemed guests including the Chief Guest – Hon’ble Mr. Justice Shripathi Ravindra Bhat, Judge, the Hon’ble Supreme Court of India. The Guests of Honour included Hon’ble Mr. Justice Najmi Waziri, Judge, High Court of Delhi, Hon’ble Mr. Justice Yashwant Varma, Judge, High Court of Delhi, and Hon’ble Mr. Justice Subramonium Prasad, Judge, High Court of Delhi. Other dignitaries included Prof. (Dr.) Alka Chawla, Professor-in-Charge, Campus Law Centre, Faculty of Law, University of Delhi, Dr. Meera Luthra, Mr. Siddharth Luthra, Senior Advocate, Ms. Geeta Luthra, Senior Advocate, Dr. Rakesh Khazanchi, Ms. Ketaki Goswami, Prof. Dr. Daksh Lohiya, Assistant. Prof. (Dr.) Harleen Kaur, Convenor, Moot Court Society, Campus Law Centre, Faculty of Law, University of Delhi and other faculty members of Campus Law Centre, Faculty of Law, University of Delhi.

The characteristic mark of a subliminal educational institution is evidenced by the methodology it adopts to teach the students how to interact with the professional world that awaits them once they step outside the benign embrace of that institution. Moot courts are the golden arrow in the quiver of such institutions to effectuate the responsibility of acquainting its students with the practical side of the practice of law. Mooting essentially involves arguing on points of law by law students before a bench of judges usually comprising of members of the faculty, practicing advocates or sitting/retired judges of various courts. Campus Law Centre lays emphasis on this activity to equip zealous students for their future paths in the profession of law and to imbibe the ‘mooting culture’ in all the students.

Every year, the Moot Court Society [‘MCS’] organises the Common Induction Moot [‘CIM’] generally in August/September to induct new members into the society. However, this year due to the close proximity of the examination dates, the MCS decided to hold this much awaited event on the 30th of October, 2021 in order to encourage larger participation from students. The ideology behind the Common Induction Moot is, “Come one, Come All. Grab the Golden Chance.” The CIM provides an opportunity for the students of all three years to become members of the most coveted society of Campus Law Centre i.e. the Moot Court Society.

This year also, the Common Induction Moot was held virtually owing to the COVID-19 pandemic. Furthermore, since first year students were not admitted to the college due to the delays in the admission process caused by the pandemic, only second year and third year students participated to exhibit their legal adroitness to the invited judges. This year’s moot problem, following the long standing tradition, was based on criminal law, with a special focus on the concept of abetment to suicide, its constituent elements and the prerequisites of criminal liability under section 305 IPC. The moot problem also tested the participants on the much debated questions of freedom of speech & expression and under which circumstances curtailment of such a right is justified. The participants were divided into various groups and were allotted a virtual courtroom. A total of 33 judges accepted the humble invitation of the MCS to grace the occasion. Each virtual courtroom was presided over by three distinct judges comprising of the esteemed academicians, alumni and practicing advocates.

After being subjected to a varying degree of courtroom pressure and adjudged on several parameters, the society inducted 31 new inductees out of the 60 participants through the CIM. The parameters on which they were judged were:

1) Application of facts

2) Understanding of law and procedures

3) Authorities and precedents cited

4) Court etiquettes and mannerisms

5) Memorials

Every year, first year students get an exclusive chance to become a member of the Moot Court Society by qualifying through the Fresher’s Induction Moot [‘FIM’]. The FIM aims at inducting students who can work towards creating a vibrant mooting culture in the college. Prior to the FIM, the MCS hosts numerous workshops and induction programs with the students, all of which were met with overwhelming response.

This year’s edition of the FIM witnessed unparalleled levels of enthusiasm and participation from the first year batch. This year’s moot proposition was based on Civil Law, with a special focus on the Contract Act, Undue Influence, Legality of Object of the Contract, and Capacity to Contract. The induction process was divided into two rounds

i) Memorial Submission; and

ii) Oral Pleadings.

The students were selected based on their knowledge of the facts of the case, awareness of the law, and drafting and advocacy skills. The participants were divided into various groups and were allotted a virtual courtroom. Each virtual courtroom had a bench of two judges comprising of esteemed academicians, alumni and practicing advocates. After being adjudged on several parameters, the society inducted 124 new inductees through the FIM. The parameters on which they were judged were:

Annual Events

Common Induction Moot

Every year the society organises a Common Induction Moot to induct new members in the society from all the three years. This moot focuses on Criminal Law and issues related to criminal jurisprudence however not limiting itself to that area in particular.

Freshers’ Induction Moot

Apart from organising a CIM for all the students in general, the society provides the freshers with an exclusive chance to get inducted in the society through the Freshers’ Induction Moot. The moot problem deals with various aspects of civil law and subjects ranging from Law of Torts to Principles of Contract.

K.K. Luthra Moot Court Competition

The K. K. Luthra Memorial Moot Court is held at the Campus Law Centre, Faculty of Law, University of Delhi (India) in the third weekend of January every year.

This Competition is the only exclusive International Criminal Law Moot Court held in India. Since 2005, the Competition has been held annually at the premises of Campus Law Centre in the memory of Late Sh. K. K. Luthra, Senior Advocate, an eminent criminal lawyer, whose legal career spanned from 1949 till his demise in 1997.

The Competition has focused on topical legal issues and subjects ranging from medical negligence, information technology and cybercrime, unlawful activities and terrorism, online banking fraud, International Criminal Law and Genocide, Impeachment of Judges of the International Criminal Court, Narcotics, Trial by Media and Defence Entrapment and related issues in criminal jurisprudence.

Campus Law Centre – Competition Commission of India Moot Court Competition

The Campus Law Centre – Competition Commission of India Moot Court Competition on Competition Law is hosted by Campus Law Centre in association with the Competition Commission of India. It aims to allow students to analyse and understand this new law and its implications. With the growing applicability of Competition Law in various sectors, it is important to prepare students who can discuss, deliberate and appreciate various facets of competition law and policy.
